Public Comment Period Open for PWFA Regulations - Texas Association of School Boards

The U.S. Equal Employment Opportunity Commission (EEOC) is welcoming public comment on a Notice of Proposed Rulemaking to implement the Pregnant Workers Fairness Act (PWFA).

The PWFA requires a covered entity to provide reasonable accommodations, absent undue hardship, to a qualified employee or applicant with a known limitation related to, affected by, or arising out of pregnancy, childbirth, or related medical conditions. The EEOC’s proposed rule addresses each element of this requirement in greater detail, provides definitions of key language in the PWFA, and provides examples of reasonable accommodations.

The EEOC invites comment from employers to include other possible accommodations and information regarding the cost of accommodation. Public comment may be submitted via the Regulations.gov website and must be received by the EEOC on or before October 10, 2023. More information is available on the Federal Register.
