The American Federation of Government Employees is entitled to emergency enforcement of an existing preliminary injunction that prohibits the Department of Homeland Security and Secretary Kristi Noem from rescinding the agency’s 2024 labor contract, governing the terms and conditions of employment for nearly 26,000 Transportation Security Administration TSOs, a federal district court in Washington held. DHS initially complied with the injunction, issued in June 2025, but Noem made a second determination in September 2025, again purporting to eliminate the TSOs’ collective bargaining rights, and DHS informed AFGE of it for the first time on December 12. The September determination’s rescission of the 2024 labor contract, cancellation of grievances and arbitrations, and elimination of AFGE’s status as exclusive representative would “[d]en[y] Plaintiffs, their members, and all bargaining unit TSOs any and all rights and/or working conditions guaranteed in the 2024 CBA,” in direct violation of the June 2025 injunction, the court found (American Federation of Government Employees v.
