Publix Super Markets Inc. again won dismissal of whistleblower suit alleging opioid prescription fraud, but this time for good.
The whistleblower, didn’t adequately allege that the company violated the False Claims Act by billing federal health-care programs after overlooking prescription “red flags,” Judge Tom Barber of the US District Court for the Middle District of Florida said in a Wednesday order to dismiss the suit with prejudice.
