A new report from the U.S. Office of Special Counsel has concluded that a Department of Education whistleblower's claims were substantiated, finding that officials under the Biden administration continued pursuing certain Title IX investigations after a federal court barred enforcement of the administration's expanded interpretation of the law in states covered by an injunction.
The report centers on allegations made by Department of Education employee Timothy Mattson, who reported that department officials continued investigating schools with policies restricting transgender students' participation in girls' sports and other sex-separated spaces despite a federal court order.
Speaking with The National News Desk, attorney Tristan Leavitt, who represents Mattson, said the findings represent an important affirmation of the whistleblower's allegations.
"The top line is that, as you said, they violated a court order," Leavitt said.
According to Leavitt, the dispute stems from the Biden administration's interpretation of Title IX to include protections based on gender identity.
"This wasn't even just athletics," he said. "This was also use of restrooms. This was participation in other activities, even traveling on school activities."
Leavitt said the administration's guidance required schools to adopt policies recognizing gender identity in a variety of educational settings.
