Retaliation claim survives in fraud against taxpayers case - Virginia Lawyers Weekly

Where plaintiff, a program manager for the City of Norfolk, alleged the city violated the Virginia Fraud Against Taxpayers Act by retaliating against her after she complained about practices and policies she viewed as wasteful, she has not stated a claim based on VFATA.

Tool policy

Plaintiff “alleges that a written policy from 2020 required that her department limit issuance of tools to one per employee.

“In November of 2020, the Assistant Director of the Utilities Department ordered her to issue tools to operational personnel as they request, without limit, and ordered her to purchase more expensive fiberglass-handled tools instead of wood-handled tools.

“Plaintiff complained to her supervisor, stating her belief that the request to issue unlimited tools ‘constituted fraud, theft, and potentially other violations of law.’

Uniform policy

“Plaintiff claims that she purchased new high visibility uniforms for 180 field employees in 2020, and as soon as those new uniforms were issued, was asked to purchase new navy-blue uniforms.

“Plaintiff complained to her supervisor about that order, claiming that it violated the City’s policy on uniforms as well as relevant workplace safety regulations. She did not place the order for new navy-blue uniforms.”
