Experts say use of tech to write complaints can lead to inflated claims and inaccuracies that could prejudice employee claims

More people are now turning to artificial intelligence tools such ChatGPT to help draft grievances and prepare claims for submission to the employment tribunal.
Travers Smith employment partner Ailie Murray said her team was seeing more employees use AI to draft claims. However, the technology can sometimes produce inaccuracies that “actively undermine or prejudice” their case, she told City AM.
“This is problematic as it does little to help resolve the employee’s issue, and in some cases creates additional costs for employers having to review and respond to lengthy submissions,” Murray explained.

Those inaccuracies have broader implications for the system as a whole, Murray warned. She said flawed claims “will put further delays in a system that is already overburdened”, pointing to recent Ministry of Justice figures showing a 32 per cent rise in open tribunal cases in 2024-25.

With the employment rights bill predicted to lead to case volumes increasing by a further 15 per cent, employment lawyers fear an influx of AI-generated claims could create an even greater burden on the tribunal system.
