Sacramento-area Italian restaurant Paesanos sued over alleged labor law violations - ABC10

SACRAMENTO, Calif. — Popular Sacramento-area Italian restaurant Paesanos is being sued over alleged violations of labor laws.

The class action lawsuit, filed in Sacramento County Superior Court on April 17, accuses the business of not providing breaks and failing to pay overtime among other labor violations.

Paesanos denies the allegations.

Defendant Allison Hurtado says she worked at the Elk Grove location from Aug. 2022 to Sept. 2024 as an hourly employee holding the positions of prep line supervisor, cook and dishwasher.

The lawsuit alleges Hurtado worked five days a week for more than eight hours a day and Paesanos did not provide her with pay at 1.5 times the regular rate when she worked overtime. It also alleges Paesanos managers told employees to work while clocked out, as well as skip meal and rest breaks.

The lawsuit alleges Paesanos failed to pay Hurtado a single meal period premium in 2024 before she left.

Paesano’s Midtown posted the following statement to social media on April 25:

"As some of you may be aware, a legal claim has recently been filed by a former employee against Paesanos. While we cannot share specific details due to the ongoing nature of the legal process, we want to assure you that we take this matter seriously. While we deny the allegations, we are addressing this situation fairly and transparently. We will continue to ensure that Paesanos complies with all state and federal labor laws.
