SCR Medical Transportation agreed to pay $1.2 million to resolve claims it failed to pay its workers minimum wage due to off-the-clock work.
The settlement benefits individuals who were employed by SCR Medical Transportation as a medical van driver since May 20, 2016, and experienced waiting in line with a mobile data terminal (MDT) device for more than 15 minutes before or after their shifts.
SCR Medical Transportation offers reliable transportation to disabled individuals in order to provide them access to friends, family, and medical services. Drivers for SCR are responsible for getting clients to their destination safely and efficiently.
According to a class action lawsuit, SCR regularly made its drivers work off the clock before or after their shifts. For over 15 minutes per shift, drivers allegedly had to wait in line before or after clocking in or out on the MDT devices in each van. Although SCR allocated 15 minutes per shift for this wait time when accounting for wages, drivers claim that they regularly had to wait for longer than 15 minutes – resulting in off the clock work.
By failing to fully compensate drivers for their time, SCR allegedly violated the federal Fair Labor Standards Act (FLSA), Illinois minimum wage law and Chicago’s Minimum Wage Ordinance.
SCR Medical Transportation hasn’t admitted any wrongdoing but agreed to resolve these allegations with a $1.2 million settlement deal.
