Siemens Medical Solutions USA Inc. convinced a New York federal court to dismiss for now a False Claims Act suit alleging that the company caused its customers to bill federal health-care programs for flawed in vitro diagnostic devices.
Whistleblower Mary Bixler Wood didn’t plead fraud with the level of particularity required by federal rules, Judge Margo K. Brodie of the US District Court for the Eastern District of New York said in an order dismissing the suit. Wood has 30 days to file an amended complaint, the court said in its Jan. 17 order.
