Singapore's ministry says enforcement action will follow if companies continue flouting overtime regulations
Singapore's Ministry of Manpower has warned of enforcement actions against employers who use fixed monthly allowances to offset overtime payments.
Manpower Minister Tan See Leng told Parliament that complaints related to such cases are small, but migrant workers who encounter such practices should inform the ministry.
"MOM will engage the companies concerned and, if necessary, take enforcement actions, including issuing warnings and imposing fines," Tan told Parliament.
Migrant workers who face a shortfall in overtime payment may file a claim with the Tripartite Alliance for Dispute Management (TADM), according to the minister.
"Those with valid salary claims, including shortfall in overtime pay, can remain in Singapore to seek alternative employment until their claims are resolved at TADM or at adjudication at the Employment Claims Tribunals," he said.
"For those who prefer to return to their home countries, remote mediation by TADM and adjudication by the ECT can be arranged."
Recent High Court ruling
Singapore's Employment of Foreign Manpower (Work Passes) Regulations state that employers of migrant workers are prohibited from offsetting overtime payments from fixed monthly allowances specified in the employment contract.
