Sleepy’s LLC delivery drivers retained group status for their wage-and-hour suit after the Third Circuit ruled Monday that the lower court was correct to certify a worker class.
More than 100 New Jersey drivers accuse the mattress retailer of misclassifying them as independent contractors when they’re really employees entitled to greater wage protections. They “present identical legal claims based on virtually identical facts,” and they can prove their claims with common evidence, making class certification appropriate, the US Court of Appeals for the Third Circuit said in an unpublished opinion.
