Corrections officers and trainees who worked at a Pennsylvania prison effectively filed their federal wage-and-hour claims against the state itself, so sovereign immunity blocks their suit, a judge said.
The named plaintiff originally sued the Pennsylvania Department of Corrections, then amended the complaint and swapped in DOC leadership in their individual capacities. The state is the “real party in interest in this case,” so sovereign immunity bars the Fair Labor Standards Act allegations, the US District Court for the Eastern District of Pennsylvania said Thursday.
