A special counsel team investigating the death of a Marine has indicted two former and current military prosecutors without detention for requesting a bench warrant against Colonel Park Jeong-hoon based on false information.
The special counsel on the 27th referred Military Prosecutor Yeom Bo-hyun and former head of the ordinary prosecution division at the Defense Ministry’s prosecution team, Kim Min-jung, to trial on charges including fabrication and use of false official documents, and wrongful detention through abuse of authority. They are accused of including false claims that “former President Yoon Suk-yeol’s anger and external pressure on the investigation were Colonel Park’s delusions” while drafting the bench warrant request for Colonel Park in August 2023 under the direction of former head of the Defense Ministry’s prosecution team Kim Dong-hyok.
Although the bench warrant for Colonel Park was rejected by the military court, he was detained for approximately 6 hours and 46 minutes between the substantive review of the warrant and the rejection decision. The special counsel determined this constituted illegal detention due to the improper bench warrant request.
Earlier, the special counsel had indicted without detention former Defense Minister Lee Jong-sup and former team head Kim for allegedly conspiring to request the bench warrant despite knowing Colonel Park did not commit insubordination, charging them with wrongful detention through abuse of authority.
