Spectrum Paint Worker Wins Tentative Group Status in Wage Suit - Bloomberg Law

A former Spectrum Paint Co. assistant manager alleging overtime violations won conditional certification for a wage-and-hour collective, but a federal judge limited the would-be nationwide group to workers at two Arkansas stores.

The suing worker sufficiently established that the paint store misclassified other assistant managers as exempt from the Fair Labor Standards Act’s overtime protections, but the universe of affected workers isn’t the “all-encompassing group” he proposed, the US District Court for the Eastern District of Arkansas said.
