Illinois-based St. James Wellness Rehab & Villas defeated a False Claims Act suit alleging a scheme to overbill Medicare for nursing and rehabilitation services by pressuring therapists to provide “unneeded therapy.”
Whistleblowers Jori Glasper and Krystal Wyckoff failed to plead fraud with the particularity required by Federal Rule of Civil Procedure 9(b), Judge Steven C. Seeger of the US District Court for the Northern District of Illinois said in a Sept. 8 order dismissing the suit. The whistleblowers have two weeks to amend their claims, Seeger said.
