State Sen. Sabrina Cervantes is suing Sacramento and its police department after being ticketed for allegedly driving under the influence following a car crash last May, even though she was sober.
Cervantes maintained her innocence and toxicology results from a blood sample tested negative for "any measurable amount of alcohol or drugs."
After the May 19, 2025, crash at 14th and S streets, the senator from Riverside County went to the hospital, where police told the media she showed signs of being impaired, including slurred speech.
The lawsuit claims police made false statements to a judge to obtain a warrant for a blood draw, which showed she was sober. The district attorney never charged her.
Her lawsuit alleges that Sacramento police leaked false information, damaging her reputation.
Cervantes is seeking damages for violation of federal rights, false arrest, unlawful search and seizure, and defamation.
KCRA 3 reached out to the city, which said it cannot comment on pending lawsuits.
