Stemming the Employment Rights Act tribunal tide - People Management

Alex Tattersall explains how businesses can prepare for a potential increase in claims

The Employment Rights Act 2025 represents one of the most significant overhauls of UK employment law in a generation. Much of the focus has been on the introduction of new workplace rights, but the reforms also create a more challenging legal environment for employers. As employees become more aware of their rights and organisations adapt to new obligations, tribunal claims are already increasing and will continue to do so over the coming years.

The reforms represent a shift in how HR policies are managed and, for organisations that fail to adapt, they increase the likelihood of workplace disputes escalating into formal legal claims.

Why tribunal claims are expected to increase

The Employment Rights Act expands a number of employee protections while placing greater responsibilities on businesses. New rights, coupled with increased regulatory enforcement and greater public awareness of workplace protections, are likely to encourage more employees to challenge decisions they believe are unfair.

Tribunal claims may arise across a range of issues: day-one protection from unfair dismissal, changes to flexible working rights, stronger protections for workers on zero-hours contracts and enhanced rights relating to family leave all create new compliance challenges.
