Strip Club Union Battle in Limbo as Disputed Votes Remain (1) - Bloomberg Law

A union’s bid to represent exotic dancers at a Los Angeles strip club awaits further litigation following the release of incomplete National Labor Relations Board election results, as no ballots were counted because of pending legal challenges.

Just one ballot was cast without any dispute over the worker’s eligibility to vote on unionizing Star Garden Topless Dive Bar, an NLRB official said Monday. Another 16 ballots will also remain uncounted until the resolution of the eligibility disputes.

Whether any of those challenged ballots are tallied and what they say will determine whether Star Garden becomes the first unionized strip club in the US since 1996, testing the reach of a nationwide union wave that’s hitting parts of the economy that aren’t typically home to labor organizing.

Strippers have turned to unionization after courtroom victories solidifying their status as employees rather than independent contractors failed to spark widespread change in the industry.

Star Garden locked out dancers after they brought safety and wage documentation concerns to management, which drew unfair labor practice charges against the club, said Andrea Hoeschen, general counsel at the Actors’ Equity Association, the union seeking to represent the dancers.
