The Human Rights Law Centre has made a submission to the Joint Standing Committee on the NDIS, to its inquiry into the integrity of the NDIS.
Currently, shortfalls in the NDIS whistleblowing regime are preventing would-be whistleblowers from safely and lawfully speaking up about wrongdoing in the scheme.
Recent amendments to the National Disability Insurance Scheme Act 2013 (Cth) whistleblower protections earlier this month were a welcome first step, but there is more to be done.
In our submission, we make recommendations that would improve protections for whistleblowers who speak up about wrongdoing under the scheme by:
- increasing access to support for whistleblowers contemplating speaking up;
- improving the handling of whistleblower complaints; and
- reducing the barriers that prevent whistleblowers who have suffered retaliation from enforcing their rights.
We urge the Albanese Government to undertake comprehensive whistleblowing reform and establish a Whistleblower Protection Authority to ensure transparency and accountability in Australia, including in the NDIS.
