Supreme Court Gives DOJ Power to Throw Out Burdensome ... - Law.com

The Department of Justice may ask that a whistleblower’s False Claims Act lawsuit filed on its behalf be thrown out even if it originally expressed no interest in the case and years of discovery have already unfolded, the U.S. Supreme Court held in an 8-1 ruling Friday.

The decision upholds the dismissal of an FCA lawsuit brought by a “relator” claiming that Executive Health Resources helped hospitals overbill Medicare.
