A Texas-based excavation and utilities company must continue to defend against a False Claims Act lawsuit alleging fraud under a pandemic-assistance program, even though the company lost its corporate charter.
Whistleblower Bryan Piper and the US government can proceed with the suit despite RKM Utility Services Inc.'s argument that it lacks capacity to face the suit, Judge Amos L. Mazzant of the US District Court for the Eastern District of Texas said in an Oct. 2 order denying a motion to dismiss.
