“Loose lips sink ships” is a World War II-era slogan that cautioned Americans to avoid casual conversations about sensitive information that, if obtained by the enemy, could harm the U.S. war effort. It became one of the most memorable phrases of the wartime home-front effort to protect operational security, troop movements, shipping schedules, and military plans. With today’s technology, however, threat actors no longer need to eavesdrop on casual conversations to gain sensitive information. From across oceans and around the world, threat actors can exploit cybersecurity vulnerabilities and hack into networks to obtain this sensitive and damaging information. And U.S. defense contractors are a prime target.

Defense contractors play an essential role in national security. They design and develop military weapons, platforms, and technology and provide specialized information technology and cybersecurity support to the U.S. government. These programs and contracts are often classified and/or involve classified or other non-public information (i.e., Controlled Unclassified Information (CUI)).1

This article provides an overview of the U.S. government’s current enforcement priorities concerning cybersecurity—in particular, the Department of Justice’s increasing reliance on the False Claims Act to incentivize and, in cases of noncompliance, penalize defense contractors who fail to meet government expectations concerning cybersecurity.
