Six decades have passed since the International Labour Organization adopted its Discrimination Convention [1] in 1958 to address sex-based discrimination in the workplace. However, the gender gap remains substantial, with the global female labor force participation rate in 2022 being 47.4%, compared to 72.3% for men [2]. This gap reflects not just actual workforce engagement but also disparities in labor law protection, as the statistics fail to account for women’s substantial participation in both remunerated and unremunerated informal activities. The law plays a pervasive and main role in shaping women’s employment opportunities. This article explores how law, from a comparative law point of view, either acts as a barrier (I) or serves to facilitate women’s entry into the job market (II).
