Second Circuit Court of Appeals Affirms Dismissal of Plaintiff’s Employment
Discrimination and Defamation Claims Arising From Her Termination
The U.S. Court of Appeals for the Second Circuit has affirmed a decision by the U.S.
District Court for the Southern District of New York dismissing a plaintiff’s employment
discrimination and defamation claims.
The Case
On May 25, 2020, Amy Cooper, a White woman, encountered Christian Cooper (no
relation), a Black man in Central Park, while she was walking her dog and he was birdwatching.
Amy Cooper (the “plaintiff”) alleged that Cooper confronted her, and that his “intentionally
aggressive actions” caused her to “fear for her safety and the safety of her dog.” She alleged that
this fear caused her to warn Cooper that she would tell the police there was “an African-American
man threatening [her] life,” and then to place a 911 call to that effect.
