A company’s ability to claim privilege over internal investigation materials is essential. Yet in May 2024, a Federal District Court in Ohio held that materials created during a company’s internal investigations were not protected by any privilege and needed to be produced to civil litigants. While the Sixth Circuit reversed that decision and reaffirmed that both the attorney-client privilege and work-product doctrine can protect internal investigative materials from production in civil litigation, practitioners should understand why the privilege assertions were called into question here and how to ensure privilege is preserved.
