TidalHealth Nanticoke Inc. and others may keep their victory in a False Claims Act suit because a whistleblower didn’t show sufficient financial connections to allege a medical equipment kickback scheme, the Third Circuit said Friday.

Chris O’Bier, owner of Peninsula Home Health Care, alleged that hospital operator TidalHealth must be paying kickbacks to a doctor and nurse practitioner it employed in violation of Medicare rules because they almost exclusively referred patients to Peninsula’s competitors, Bay View Homecare Inc. and Lincare Inc.
