Retaliation and whistleblower claims have been on the rise over the last several years and that trend is likely to continue into 2026. In 2024 (the most recent year for which statistics are available), charges alleging retaliation made up almost half of the over 88,000 charges filed with the Equal Employment Opportunity Commission (EEOC).
