Topeka's city government paid $12,500 last spring to attorneys representing Keith Bennett, a former city employee, to settle a federal lawsuit he pursued alleging discrimination and retaliation.
Bennett then sued the city again last week alleging it committed retaliation against him as he pursued the first suit.
The city as of Sept. 3 hadn't officially been served with the lawsuit, said Dan Garrett, its communications and media relations director.
"The city will review the lawsuit once it is officially served, though at first glance, it appears largely duplicative of claims Mr. Bennett has already resolved," he said.
Bennett first sued city in December 2023
Bennett was employed by the city's water distribution division before he left city employment last September, court records said.
Attorneys Bruce Alan Brumley and Chloe Elizabeth Davis represented Bennett, who is 55 and Black, in the suit he initially filed against the city in December 2023.
The suit contended the city discriminated against Bennett by passing him over for promotion to a job he applied for in September 2022 in favor of a younger White co-worker.
It alleged one count each of discrimination and retaliation on the basis of race, and discrimination and retaliation on the basis of age.
