Former employees and councillors from a local township — including current Midland CAO Rhonda Bunn — are calling for a lawsuit against them to be dismissed.
In a statement of defence obtained by Village Media, the defendants who worked or served at the Corporation of the Township of Adjala-Tosorontio deny the allegations contained in plaintiff Nadeem Munawar Dean’s statement of claim and reject his demand for financial compensation.
In fact, the statement of defence filed in Barrie Superior Court of Justice notes that while Bunn was employed by the township as the CAO, she had resigned from the role by the time Dean’s employment with the municipality had been severed.
“Bunn is not a proper party to this action,” the statement says, adding the other defendants are also not proper parties to this action.
Dean, who was employed by the township from Oct. 7, 2019 until April 27, 2022 as the finance director/treasurer, filed the lawsuit last year levelling a number of allegations against the municipality, the current mayor, three former councillors and two previous CAOs.
Dean is seeking $102,000 for wrongful dismissal and $60,000 in “moral damages,” $50,000 for intentional infliction of mental suffering and $70,000 for “damages for injury to the plaintiff’s dignity, feelings and self-respect, pursuant the Human Rights Code.”
Dean is also seeking $100,000 in aggravated damages, $400,000 in punitive damages and “special damages in an amount to be determined at trial."
