R&L Carriers truck drivers could face sanctions if they keep alleging violations related to Fair Labor Standards Act claims already dismissed without leave to amend, a federal judge said.
The truckers’ most recent complaint included allegations related to the nixed federal minimum wage and overtime claims, despite an “unequivocal warning” to leave them out, the US District Court for the Central District of California said. Because of the workers’ “repeated disregard” of court orders, Judge Mark C. Scarsi said he “will not hesitate to impose sanctions in response to future violations.”
