Federal employees now face the possibility of being disciplined or fired for misconduct based on the government’s “suitability and fitness” standards, on top of already-existing disciplinary proceedings.
A final rule from the Office of Personnel Management, scheduled to publish Tuesday to the Federal Register, will let agencies apply the same considerations they use to determine whether federal job applicants are “fit” for government employment to all current federal employees as well.
OPM’s change would allow for expedited firings of federal employees if they are deemed to no longer meet the government’s suitability and fitness standards, aligning with other efforts from the Trump administration to expand agencies’ flexibility for removing federal employees.
OPM said its final rule will make the suitability and fitness process more efficient and rigorous, as well as ensure consistent application of suitability actions and merit system principles. The rule takes effect in 30 days and comes after OPM first issued proposed regulations in June 2025.
“For too long, the federal government has had stronger tools to prevent someone with serious misconduct from entering public service than to address the same misconduct once that individual is already employed,” OPM Director Scott Kupor said Monday. “This rule closes that gap, strengthens accountability and helps ensure the federal workforce continues to earn the trust of the American people.”
