Trump Era DOJ Lawyer Clark Asks US Court to Block Discipline (1) - Bloomberg Law

Former Trump Justice Department official Jeffrey Bossert Clark asked a federal court to intervene in and block disciplinary charges brought against him over claims he attempted to help overturn the 2020 election.

Clark, who announced last year he would head up strategic litigation efforts at a civil rights nonprofit after serving as top environmental lawyer under the Trump administration, was accused of attempting to engage in dishonesty in connection with his 2020 election advice to Trump.

Counsel to Clark said the case doesn’t belong before the D.C. Board of Professional Responsibility.

“Mr. Clark is in front of the DC Bar’s Board because the head of the DC Office of Disciplinary Counsel dislikes the advice he believes Mr. Clark gave to former President Trump when he headed two of DOJ’s seven litigating Divisions from late 2020 into early 2021,” Burnham & Gorokhov PLLC said in a statement on the firm’s website. “This is a flagrant misuse of the disciplinary function because no state bars, let alone the local D.C. Bar, have jurisdiction to supervise the advice rendered by presidential advisors or circulated purely inside the halls of the Justice Department.”

The filing makes numerous arguments for federal jurisdiction and for timeliness of the attempted removal.
