TSA employee considers lawsuit against North Bend City officials - KCBY.com 11

NORTH BEND, Ore. — North Bend city officials could be at the center of a lawsuit from a Transportation Security Administration employee who says city officials made false claims against him.

On the afternoon of April 14, TSA employee Josh Scarberry initiated a Law Enforcement Incident Response Test at the Southwest Regional Airport in North Bend, according to the TSA.

The tests are used to check response times of local police to threats.

In a letter dated July 20, North Bend City Manager David Milliron claimed that Scarberry sent a false report of a "firearm in the X-ray" on April 14.

On that day, Scarberry requested an officer meet him at the screening checkpoint, according to Milliron's letter. According to Milliron, a North Bend Police officer left a call at North Bend High School in order to respond to Scarberry's call at the airport.

When the officer arrived, Milliron says Scarberry informed the officer that the call was a TSA test.

On Friday, October 28, Scarberry sent a tort claim notice, a precursor to a lawsuit filing, to North Bend Mayor Jessica Engelke and the City Council.

The claim accuses City officials of causing harm to Scarberry with what his lawyer Ronald Iparraguirre called false accusations leveled against his client multiple times.

Iparrafuirre says the investigation meant his client was stripped of access to the Coos County Airport District, and put on administrative leave.
