Your landlord rented your villa to someone else? Here’s how to fight back

Question: Two years ago, I rented a villa. Four months ago, the owner of the villa asked me to vacate it on the pretext that he wanted to use it for his son. However, I discovered that he rented it to a third person instead. Do I have the right to request compensation for the amounts I paid due to his claims, including moving costs and additional rental expenses?

Answer: You have the right to request fair compensation if you can prove that the landlord did not use the villa for his son as claimed, because the landlord may not rent the property to a third party before the lapse of at least two years in such a case.

This is stipulated by Article 26 of Law No. (33) of 2008 amending Law No. (26) of 2007 regulating the relationship between landlords and tenants in the Emirate of Dubai. (Where the Tribunal rules in favour of the landlord retaking possession of the property for his own use or for use by any of his first-degree relatives, in accordance with sub-paragraph (2)(c) of Article 25 of this law, the landlord may not rent the property to a third party before the lapse of at least two years in the case of residential property, or three years in the case of non-residential property, from the date of retaking possession. Otherwise, the tenant may request the Tribunal to award fair compensation.)
