U’khand HC rejects vet’s transfer stay plea over ‘false’ claim naming mom as cancer patient - The Times of India

Dehradun: Uttarakhand high court (HC) has dismissed a petition filed by a govt veterinary officer challenging her transfer from Dehradun to Pantwari in Tehri after finding that she had “falsely” claimed in her application to the department that her mother, instead of her mother-in-law, was undergoing cancer treatment to seek exemption under the medical provisions of the Uttarakhand Public Servants Annual Transfer Act, 2017. A bench of Chief Justice Manoj Kumar Gupta and Justice Subhash Upadhyay held that the “deliberate misrepresentation” was sufficient to reject her claim.The officer had sought exemption from the department on the ground that she was the sole caregiver for her mother, who she claimed was undergoing cancer treatment at AIIMS Rishikesh. Her request was rejected as she had already exceeded the maximum permissible tenure of four years at an accessible station under the transfer Act. She subsequently approached the HC, stating in her petition that it was her mother-in-law, and not her mother, who was undergoing treatment.The petitioner’s primary contention was that her transfer order should be quashed under section 3(f) of the transfer Act, which exempts public servants from transfer if they are required to care for family members suffering from serious illnesses.
