Under Armour Worker Unable to Sue Company as 'Person' for Bias - Bloomberg Law

A former Under Armour Inc. worker in West Virginia who is unable to sue the company as her “employer” for alleged job discrimination because it had fewer than 12 in-state employees also can’t sue the company as a “person,” the state’s top court said.

Answering a federal judge, the West Virginia Supreme Court of Appeals said the provision of the West Virginia Human Rights Act cited by Cynthia Pajak doesn’t include in its definition of “person” companies like Under Armour that don’t fit the definition of “employer” in a different section of the act.
