A class-action lawsuit has been filed on behalf of employees who say United Furniture, which has operations in the Triad, ended their employment without giving adequate notice under federal law and owes them back pay.
The suit was filed Tuesday in federal court for the Northern District of Mississippi, where United Furniture Industries is headquartered. The plaintiff is Toria Neal, who says in the complaint she worked for United in Mississippi since 2019 until getting notification late Monday that the company was terminating all employees immediately.
Neal alleges that United notified its employees moments before midnight by email and text messages that it was terminating them all, with the exception of over-the-road drivers. Neal alleges that the company said the terminations were expected to be permanent, and without a provision under the law that allows employees to continue health insurance coverage after leaving a job.
The claim contends that United failed to give the 60 days advance written notice of termination that is required of employers of more than 100 people under most circumstances under the Worker Adjustment and Retraining Notification Act.
According to the U.S. Department of Labor, employers who violate the 60-day provision may be liable to each employee for back pay and benefits up to the 60 days.
