Aetna Inc. subsidiary Medicare Medicaid Advisors, UnitedHealthcare Insurance Inc., and others showed that a False Claims Act suit alleging Medicare fraud schemes shouldn’t be revived, the Eighth Circuit said Friday.
Insurance agent and whistleblower Elizabeth Holt alleged that MMA and defendant insurance carriers—which also included Humana Inc. and Aetna—violated the FCA by engaging in unlawful business practices, such as making false representations to Medicare beneficiaries while marketing Medicare Advantage insurance plans. She also alleged that MMA falsely attested that its agents were certified to sell Medicare Advantage plans when MMA knew its agents were not.
