A whistleblower can continue to allege that UnitedHealthcare of Georgia Inc. and others violated the False Claims Act by improperly billing Medicare Part C, a federal district court said.
Whistleblower Brook Gonite plausibly alleged FCA violations by alleging the time, place, and substance of alleged fraud, Judge Marc T. Treadwell of the US District Court for the Middle District of Georgia said in a Wednesday opinion partially denying the defendants’ motion to dismiss.
The court also rejected the defendants’ argument that the FCA whistleblower provisions are unconstitutional.
The case is United States ex rel. Gonite v. UnitedHealthcare of Ga. Inc., M.D. Ga., No. 19-cv-246, 4/23/25
