On February 7, 2023, the Department of Justice (“DOJ”) released its report on False Claims Act settlements and judgments for the government’s FY 2022. DOJ recovered approximately $2.2 billion in fines and penalties, resulting from 351 settlements and judgments (the second-highest number of settlements in history). Interestingly, the $2.2 billion recovery was significantly less than the $5.6 billion recovered in FY 2021. Breaking down the $2.2 billion in FY 2022 recovery, more than $1.9 billion arose from lawsuits filed under the qui tam provisions of the False Claims Act, and approximately $1.7 billion was related to healthcare recovery. In addition to health care, other False Claims Act recoveries involved COVID- related fraud, cybersecurity representation fraud, and manipulation of small business set-aside contracts.
