U.S. News & World Report allegedly fired a division head two hours after he pushed for $1.5 million in unpaid incentive pay.
A federal court in Washington, DC, ruled on September 28 that most of his claims can proceed.
The worker headed U.S. News's 360 Reviews division from 2018, earning incentive compensation through two Long-Term Incentive Compensation (LTIC) plans and a bonus plan worth up to $150,000. According to the complaint, he hit the highest revenue thresholds - $1.5 million owed under the 2020 LTIC plan, $250,000 under the 2022 plan, and $132,350 under the 2024 bonus plan.
Then the payments dried up.
U.S. News ran into financial trouble in 2025. On March 31 - the date an LTIC payment was due - the Chief Financial Officer (CFO) told the worker the CEO did not "feel good" about paying. A revised, reduced plan was offered. The worker said no. A partial payment eventually arrived, but a June 30 instalment never did. His 2024 bonus was slashed from $132,350 to $71,398, and only half was paid.
In September 2025, the worker emailed leadership demanding what he was owed. The next day, the complaint alleges, the CFO gave him a choice: accept less to "get some cash" and keep his reputation, or the company would fire him "for cause" to withhold his remaining payments. When the worker asked what the cause would be, the CFO said it was not defined and they would "be researching and fighting over it with lawyers."
Two hours later, the termination email landed.
