US Oncology won dismissal of a whistleblower’s False Claims Act suit alleging the company defrauded Medicare by submitting claims for improperly administered drugs.
Whistleblower Omni Healthcare Inc.'s suit must be dismissed under the FCA’s public disclosure bar because a prior lawsuit disclosed similar claims, and Omni didn’t satisfy the original source exception to the bar, Judge Nina Gershon of the US District Court for the Eastern District of New York said Sept. 8, granting a motion to dismiss.
Omni didn’t plead that it has direct knowledge of the information on which the allegations are based, the court said.
