Federal prosecutors properly won dismissal of a whistleblower’s False Claims Act suit alleging that operators of an Alabama pain management clinic submitted fraudulent claims for payment to federal health-care programs, the Eleventh Circuit said Monday.
The government provided good grounds for seeking dismissal, such as how whistleblower Lori L. Carver “made little progress” in obtaining a judgment in the several years she controlled the litigation, the US Court of Appeals for the Eleventh Circuit said in a nonprecedential opinion.
