Utah employers must keep up with a slew of new state workplace laws that kicked in this month. Here are the top five that will impact private employers in the Beehive State.
5 Key Workplace Laws (Effective May 6 – With Additional Upcoming Deadlines)
1. Ban on Healthcare and Veterinarian Noncompetes (HB 270 and SB 111)
Utah employers are now banned from entering into noncompete agreements with most licensed healthcare workers and all veterinarians (excluding veterinarians with at least a 5% ownership in their business). Any such noncompete agreements entered into on or after May 6 will be deemed void by the state.
In addition, the following types of agreements are now considered to be void if entered into on or after May 6:
- a nonsolicitation agreement with a covered healthcare workers that prevents the worker from informing a patient of their current or future place of employment;
- any nonsolicitation agreement with a veterinarian; or
- any nondisclosure clause with a veterinarian.
2. Hospital Workplace Violence Reporting Requirements (HB 380)
Utah hospitals must establish a workplace violence incident reporting system no later than November 1 that:
- collects certain detailed information regarding a workplace violence incident;
- is clearly communicated to all employees, including new employees at orientation;
- includes guidelines on when and how to report incidents of workplace violence to the employer, security agencies, and appropriate law enforcement authorities; and
