Voluntary Dismissal of Single Claim Isn't Valid, 11th Cir. Says - Bloomberg Law

A procedural rule allowing plaintiffs to voluntarily drop their allegations requires dismissing the whole action, not just a single claim within it, the Eleventh Circuit said in a Friday wage-and-hour opinion.

The parties here—VMSB LLC, the corporate entity behind Gianni’s Restaurant at the former Versace Mansion in Florida, and workers who say it stiffed them on wages—tried to use the rule at issue to toss one of three counts, so the lower court never rendered a final judgment and the US Court of Appeals for the Eleventh Circuit lacks jurisdiction over the workers’ appeal.
