Walmart defeated a discrimination suit after a former employee failed to show the effects of a stroke he suffered qualified him as “disabled” under the federal civil rights law, an appeals court said.
A lower court’s decision that Timothy Capers did not qualify for coverage under the Americans with Disabilities Act because Capers couldn’t show his residual symptoms along with his diabetes “substantially limited his abilities to perform major life activities,” was upheld by the US Court of Appeals for the Fifth Circuit in a Wednesday opinion.
