Walmart Loses Bid to Trim Worker Claims in Meal Break Dispute - Bloomberg Law

Walmart Inc. must face a suit alleging its employees worked through meal breaks without pay after a federal judge in Pennsylvania rejected the company’s attempt to partially dismiss the case.

Robert McEnheimer, the hourly worker behind the would-be class suit, adequately alleged an implied contract obligating the retailer to pay for work performed during mandated meal breaks “independent of any statutory entitlement to compensation,” the US District Court for the Western District of Pennsylvania said.
