The family of a WestRock Co. facility worker who collapsed and died after his supervisor threatened to fire him when he said he needed to go the hospital can proceed with its FMLA interference and wrongful death claims.
Cornelius Heard Sr.'s family sufficiently alleged a Family and Medical Leave Act claim, the US District Court for the Eastern District of Tennessee ruled Tuesday. It also denied dismissal of the wrongful death claim because it’s currently unclear whether Heard’s death is covered by the state’s workers’ compensation law.
