Whistleblower: Did hospital hide emails in fired CEO’s case? - Yahoo

CLEVELAND (WJW) – A FOX 8 I-Team camera was rolling for a showdown in court over a whistleblower’s complaint of possible hidden emails.

It’s the latest turn in a lawsuit filed against MetroHealth Medical Center by a former CEO.

The hospital fired Dr. Akram Boutros in 2022. He has since filed a lawsuit. He and his attorneys have been asking for all his emails and said they have not received them, even though hospital officials told them all documents were turned over.

“So, this whole timeframe where we are told we have everything, it just isn’t true,” Attorney Kevin Spellacy, said during a hearing Monday in Cuyahoga County Common Pleas Court. “It is clear these documents existed and we weren’t given them.”

Spellacy is part of the legal team for Dr. Boutros. Spellacy said they didn’t receive the new emails until after a whistleblower sent information a few weeks ago to them and a judge.

Attorneys representing the hospital said the emails were from an out-of-use system, so they did not know the emails existed.

“The suggestion we are trying to hide documents from them is insulting. It is unprofessional and they have no evidentiary basis for it,” Attorney Mark Wallach said during the hearing.

Wallach also added in a brief filed with the court that after the anonymous complaint from the whistleblower was filed, officials found “two archived files containing emails to and from” Boutros “from the years 2013 through 2019.”
