FARGO, N.D. (Valley News Live) - A Fargo server says she is still waiting to be paid more than $6,000 in wages and penalties, even after North Dakota labor officials ruled in her favor and called her claim “enforceable.”
The case centers on Dakota Food Group, LLC, which operated Teddy’s Eatery and Back Alley Bar at 212 Broadway N, Fargo, ND 58102. Teddy’s is now closed at that location but is currently operating at Cellar 624 on Main Avenue.
Nicole Vogel says she was hired for a supervisor role at Teddy’s, worked about eight weeks, and says she was never fully paid for the hours she worked.
“I continued to not get paychecks, so what right person would work for free, you know?” Vogel said.
Vogel says when she started asking why she wasn’t being paid, she was given shifting explanations.
“She blamed it on my name change. I had just gotten divorced, I switched back to my maiden name, then it was just every excuse in the book to not pay me,” she said. “I tried to meet with her... she wouldn’t show up.”
According to a 260‑page activity log from the North Dakota Department of Labor and Human Rights, Vogel filed a wage claim on March 8, 2023.
The department spent more than a year collecting emails, timesheets, and payroll records.
